The amendment proposes the following: 1. Amend the existing Significant Landscape Overlays Clause 42.03 Schedule 1 Blackburn Area 1 Schedule 2 Blackburn Area 2 and Schedule 3 Walker Estate in the following manner: delete the following clause in 3.0 Permit requirement: A permit is required to remove destroy or lop a tree with a single trunk circumference greater than 0.5 metre at a height of one metre above ground level. This does not apply to the pruning of a tree for regeneration or ornamental shaping. and replace it with the following: A permit is required to remove destroy or lop a tree. This does not apply to: A tree having a single trunk circumference of 0.5 metre or less at a height of one metre above ground level. The pruning of a tree for regeneration or ornamental shaping. A tree which is dead or dying. 2. Amend the existing Significant Landscape Overlay Clause 42.03 Schedule 4 Blackburn Early Settlement Neighbourhood Character - Vegetation Retention in the following manner: under Clause 3.0 Permit requirement add the following new dot point: A tree which is dead or dying. 3. Vary the Municipal Strategic Statement and Local Planning Policy Framework to recognise the introduction of additional Significant Landscape Overlays in Mitcham and Vermont. 6. Update the list of maps in the Whitehorse Planning Scheme. Why the Amendment is required This amendment is required for the following reasons: To include land in Character Areas 14A 16A and 17 of the Whitehorse Character Study 2002/03 in a Significant Landscape Overlay. The Significant Overlay will recognise the contribution of the areas for their landscape qualities. To expand the permit exemption provisions in the Significant Landscape Overlay relating to removal lopping or destruction of protected trees to include trees that are dead or dying. I
