Amendment C049 (Yarra Ranges)

The Amendment proposes to change the Yarra Ranges Planning Scheme by rezoning the land at 3457 and 3475 Warburton Highway Warburton (the former Sanitarium factory site and unreserved Crown Land adjacent formerly used as a sawmill) to facilitate development and use of the land for a visitor accommodation resort (residential hotel) with associated conference tourist facilities and spa facility with associated car parking. The amendment will also rationalise zone boundaries with property boundaries ensuring that all of the development site is covered by a Business 2 Zone and the section of river bank currently zoned Business 2 is returned to a Public Park and Recreation Zone. The rezoning will consist of the following components: A section of the former sawmill site rezoned from Industrial 3 Zone to Business 2 Zone to accommodate the proposed development A section of unreserved Crown Land being part of the former sawmill site rezoned from Public Park and Recreation Zone to Business 2 Zone to accommodate the proposed development The remainder of the unreserved Crown Land being part of the former sawmill site rezoned from Industrial 3 Zone to Public Use Zone 6 (Local Government). This land will come under a committee of management arrangement through Council and will be used for car parking and access associated with the proposal and surrounding recreation and business uses Part of the riverbank area abutting the northern boundary of the former Sanitarium factory rezoned from Business 2 Zone to Public Park and Recreation Zone The easternmost part of the development site immediately north of the adjacent Signs Publishing building rezoned from Low Density Residential Zone to Business 2 Zone to accommodate the proposed development A draft planning permit (Planning Application YR2004/934) for development and use of the land for a visitor accommodation resort (residential hotel) and associated conference tourist facilities and spa facility with associated car parking is included as part of this amendment under Section 96 of the Planning and Environment Act 1987. The uses and development to be authorised under planning permit YR2004/934 include a 104 unit 5 star visitor accommodation resort (residential hotel) and spa facility with associated conference and tourist facilities. The spa conference and tourist facilities are to be located in the former Sanitarium factory building which will be refurbished. The visitor accommodation component of the proposal is to be located in two separate (new) four-storey buildings. One will be located between the river and the neighbouring Signs Publishing building immediately to the east of the Sanitarium building. The other will be located immediately to the north-west of the Sanitarium building on land formerly occupied by the sawmill.
